A company is to market a generic version of Pfizer’s Viagra after the company learned that it would have to make an upfront payment of up to $2.5 billion to settle lawsuits alleging the drug was linked to negative health effects.
The move came on the heels of a New York court ruling that ruled Pfizer could not be held liable for the negative side effects of the drug because it failed to disclose the information about Pfizer’s plans for generics and the potential legal action against the company in federal court.
Pfizer, which manufactures the drug, is seeking to have its product generic for the treatment of erectile dysfunction. The company will also appeal a lower court ruling that it has no liability for the negative side effects of Viagra’s use. The settlement agreement was not disclosed by the company.
The company’s lawsuit against Pfizer alleging the drug was used in the promotion of its own drugs, but Pfizer’s own lawsuit said it “has no basis” for its allegations.
The company said it had to pay $2.5 billion in damages to resolve the claims and will appeal the ruling on April 14, the company said.
